Terms of Service
1. Who we are
MumbleMe ("we", "us") provides hosted Mumble voice servers at mumbleme.com. You can contact us at [email protected] or through mumbleme.com/support.
These terms are an agreement between you and us when you create an account, start a free trial or buy a server. Please read them together with our Privacy Policy.
2. The service
A MumbleMe server is a private Mumble voice server that we host and run for you. It comes with:
- an address;
- a control panel in your browser for channels, permissions, passwords and settings;
- the number of slots you choose. A slot is one person connected at the same time.
You can host your server in the regions we offer, currently the United Kingdom and the United States.
Mumble itself is free, open-source software that we do not make. We run it for you and keep it updated. Your users connect with any Mumble client.
3. Your account
- To create an account you need an email address, or a Google account if you sign in with Google. You must give accurate details and keep access to that email address.
- You must be at least 18 years old to open a server, including a free trial.
- You are responsible for everything done through your account and on your servers. That includes what your users do on a server you run.
- Keep your server's SuperUser password and join password safe. We show the SuperUser password to you only once.
4. Free trial
- New customers can try one server free for 5 days, with 10 slots, without giving card details. There is one trial per person and per account.
- The 5 days start when the server is ready, not when you sign up.
- If you do not buy a paid plan before the trial ends, the server stops when the trial ends. It is kept for 24 hours and then deleted, with its settings and data.
- If you buy a paid plan before then, the same server carries on with its address, channels and settings.
- We may change or end the free trial offer for new sign-ups at any time.
5. Prices and payment
- Prices are shown on mumbleme.com/pricing before you sign in, in pounds sterling (GBP). Any dollar or euro amounts are estimates only. MumbleMe is not VAT-registered, so no VAT is added: the price you see is the price you pay.
- You pay by card through Stripe. We never see or store your card details.
- Subscriptions renew automatically. You pay when you buy, then again at the start of each month or year, whichever you chose, until you cancel.
- Changing size. If you add slots, the extra is charged straight away for the rest of the current period. If you remove slots, the change takes effect at your next renewal.
- Price changes. We will give you at least 30 days' notice by email before a new price applies to your subscription. You can cancel before it takes effect.
- Customers from our previous system who still pay through a PayPal subscription carry on as before until that subscription ends.
6. Cancelling, and when payment fails
- You can cancel at any time from your server's billing page in your account. Your server keeps running until the end of the period you have already paid for, and does not renew.
- If a renewal payment fails, your server keeps running for a 7-day grace period while payment is retried. If it is still unpaid after that, the server is stopped.
- After a server stops because its subscription ended or went unpaid, we keep it, with its data and address, for 90 days. You can restore it by paying again. After 90 days it is deleted and its address may be given to someone else.
7. Refunds and your right to cancel
- The 14-day right to cancel. If you live in the UK or the EU, you can cancel a new paid subscription within 14 days of buying it. Your server starts as soon as you pay, and when you buy you agree that it starts straight away. So if you cancel within the 14 days, we refund what you paid minus a proportionate amount for the time the server was available to you. To cancel this way, email [email protected] within the 14 days.
- After 14 days, payments are not refundable. If you cancel later, your server keeps running until the end of the period you have already paid for, then stops.
- If we cannot provide a server you have paid for, we refund the payment in full.
8. Acceptable use
You must not use MumbleMe, or let your users use your server:
- for anything illegal, or to plan, promote or carry out illegal activity;
- to harass, threaten, abuse or exploit anyone, or to share content that sexually exploits children (which we report to the authorities);
- to spread malware, send spam, or attack, probe or overload any system, including ours;
- to infringe anyone's copyright, trademark or other rights;
- to give a server or an address a name that is a slur, hateful or offensive. We may refuse such names when you choose them and change them if they get through;
- to resell or sub-let servers, unless we have agreed to it in writing;
- in a way that puts an unreasonable load on our systems or harms other customers' service.
What we may do. If you break these rules, we may warn you, change a name, or suspend or close the server or account. Where the breach is serious or illegal, we may do so without notice. If we close a server for a breach, we do not refund the remaining period.
Content on your server is yours. You are responsible for it, and for your server's own rules and moderation. We do not monitor conversations. Mumble voice is not recorded by us.
9. Availability and changes to the service
- We work to keep servers running around the clock, but we cannot promise uninterrupted service. Maintenance, faults and events outside our control can cause interruptions. We do not offer an uptime guarantee or service credits.
- We may update Mumble, our platform and the control panel. We may change or remove a feature if we have a good reason, and we will tell you in advance if a change significantly affects a server you pay for.
10. Ending this agreement
- You can close your account at any time once you have no active paid servers. Closing it ends these terms; any parts that by their nature should continue, such as sections 11 and 12, still apply.
- We may close an account with 30 days' notice. If we do, we refund the unused part of any period you have paid for. We may also close one straight away for a serious breach of section 8.
11. Our liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that cannot be limited by law. Nothing affects your statutory rights as a consumer.
- We are not liable for losses that were not foreseeable, for business losses (lost profits, revenue or data you could have backed up), or for problems caused by your users, your devices or your connection.
- Otherwise, our total liability to you is limited to the amount you paid us in the 12 months before the claim.
12. General
- Changes to these terms. We may update these terms. If a change matters to you, we will email you at least 30 days before it applies, and you may cancel before then.
- Law. These terms are governed by English law (the law of England and Wales), and its courts can hear any dispute. If you are a consumer living elsewhere in the UK or the EU, you keep the protection of your local law and can bring a claim in your local courts.
- If any part of these terms cannot be enforced, the rest still applies.
- These terms and our Privacy Policy are the whole agreement between us about MumbleMe.
